Is the patent lawsuit 'sour grapes,' or did Apple benefit from Nokia research without paying?

Nokia: Suing Apple over iPhone

Nokia is trying to take a bite out of Apple's iPhone sales.

Nokia is suing Apple over the iPhone, said Jay Yarow in The Business Insider, accusing Apple of patent infringement on 10 wireless technologies. But the 1- to 2-percent royalty Nokia is demanding amounts to as little as $6 per iPhone. Nokia looks "silly" for trying to squeeze "pocket change" from Apple instead of focusing on building a better product.

The online world is screaming in unison that Nokia is only suing because it can't make a phone as good as iPhone, said Rupert Goodwins in ZDNet UK. But Nokia is no "patent troll" it has been in discussion with Apple for a year, and apparently "genuinely believes" Apple has taken the benefits from Nokia's research and development without paying. "It all looks and sounds like a case with substantial grounds."

Sure, Nokia probably has a case, said Dan Roberts in Britain's The Guardian. "Both sides have failed to agree a licensing deal, but Apple continues to churn out iPhones by the millions." Nokia should have learned when it fought to a standstill with Qualcomm over patents that such bickering doesn't accomplish much. If it doesn't want people to think this is just "sour grapes" over iPhone's success, Nokia should fight Apple "where it counts—in the showroom."

Posted by Steve, Friday, October 23, 2009, 7:09 pm Have you done any research at all before writing this tripe? This is such a onesided piece of halfbaked journalism that it's surprising it's not paid for by Steve Jobs.

Posted by Sense Of Reason, Friday, October 23, 2009, 7:35 pm In the world of intellectual property or technological innovation the creator of a telephone function has to be afforded legal protection over their property. Using the in the showroom argument is ridiculous. Let's use a more tangible product as an example. In the famous case of the intermittent windshield wiper, automobile manufacturers that stole the technology were held legally liable for the theft. Apple has been bargaining in bad faith with Nokia using Nokia's property without permission nor payment.

Posted by Fred, Saturday, October 24, 2009, 6:01 pm Yeah, this article is right. Nokia should suck it up and let their work be stolen. We'll all tell them to suck it up because America seems ready to believe that Apple can do no wrong.

Posted by Mark, Sunday, October 25, 2009, 6:10 am Nokia should fight Apple where it countsin the showroom. This is such garbage. The entire point of getting a pattent on a peice of research is so that the multimillions of dollars spent on research are protected from someone coming along and stealing your idea. Nokia is more then just in their right to sue apple for using their technology. People are so caught up by the Apple fad that they're loosing focus on how the world works.

Posted by Alan, Tuesday, October 27, 2009, 1:07 pm This is absolute nonsense. Patent laws serve a very important purpose, i.e. to encourage research and innovation.

Posted by Jonathan, Wednesday, October 28, 2009, 6:08 pm the very Phone you speak of was Stolen by Alexander Grahm Bell at the patent office when the inventor who was trying to patent it found he hadn't got the money to do so Bell filched the plans that were left there, patented them before the inventor returned and live a high life off a lie and one of the greatest travesties of justice in the modern age. The patent system as it is screws most over for the power control and profit of the few and keeps our civilization down by legal proxy. Deal with THOSE issues and tis debate will have meaning..

Posted by James, Thursday, October 29, 2009, 3:34 am Fk Apple. If they've stolen intellectual property then they should be held accountable, regardless of how 'small' the desired penalty from Nokia is.
